Usage policy

LA VEU LLIURE S.L. (hereinafter, "the Company"), with registered office at Passatge Arnaldeta de Caboet, 11 Edifici La Torre, 2n 1a, Escaldes-Engordany, Andorra, AD700 and Tax Identification Number (NIA) L-721495-L, is the owner and entity responsible for the website www.laveulliure.ad (hereinafter, the "Website"), through which it provides a journalistic information service that allows users to register, log in, and post comments and ratings on its publications.

This policy shall also apply to website users who post comments without having a registered user account.

1. Object and Scope of Application

This Policy of Use (hereinafter, the "Policy") governs the conditions of registration, access, and use by users (hereinafter, the "User" or "Users") of the features for account creation, login, comment posting, and rating of the Website's editorial content.

Registering as a User and using the commenting and rating features imply full, express, and unreserved acceptance of this Policy, which must be read together with the Website's Privacy Policy.

Any User who does not agree with the entirety of this Policy must refrain from registering or using the commenting and rating features.

2. Applicable Legal Framework

The Company is domiciled and provides its services from the Principality of Andorra; therefore, this Policy is primarily governed by Andorran law.

3. User Registration and Access

To comment on and rate publications, the User may register in advance by creating a personal, non-transferable account through the form provided on the Website.

Registration requires the User to provide truthful, accurate, complete, and up-to-date information. The User is solely responsible for the accuracy of the information provided and for keeping it updated.

Only adults of legal age with full legal capacity may register. The Company may request age verification at any time and, in case of reasonable doubt or upon detecting the registration of a minor, suspend or cancel the account in accordance with clause 9.

Each User may only hold one account. Creating multiple accounts, impersonating third parties, and transferring, selling, or assigning an account are strictly prohibited.

The User is responsible for safeguarding their login credentials and for all activities carried out from their account, and must immediately notify the Company of any unauthorized use or security breach of which they become aware through the channel indicated in clause 13.

4. Personal Data Processing

Personal data provided during registration and those derived from User activity on the Website (comments, ratings, connection metadata) will be processed by the Company, in its capacity as data controller, in accordance with the Andorran Data Protection Act (LQPD) and its development regulations.

The purposes of processing, legal basis, retention periods, potential disclosures or international data transfers, and the procedure for exercising rights of access, rectification, erasure, objection, restriction, and data portability are detailed in the Website's Privacy Policy, which forms an integral part of the contractual relationship with the User and must be consulted independently of this Policy.

In the event of a personal data security breach that poses a risk to the rights and freedoms of Users, the Company will notify the Andorran Data Protection Agency (APDA) within a maximum period of seventy-two (72) hours of becoming aware of it, in accordance with the LQPD, and will inform affected Users when required by regulations.

Comments and ratings posted by the User are publicly visible. The User must refrain from including personal data—whether their own or belonging to third parties (addresses, telephone numbers, health data, affiliation, orientation, etc.)—and remains solely responsible for the consequences arising from their voluntary publication.

5. Code of Conduct for Comments and Ratings

The User undertakes to use the commenting and rating features in good faith, in compliance with the law, public order, and these rules, refraining in particular from:

  • Posting libelous, defamatory, or slanderous content regarding the Company, its professionals, other Users, or third parties.
  • Expressing statements that constitute incitement to hatred, violence, or discrimination based on origin, race, sex, religion, sexual orientation, disability, or any other personal or social condition or circumstance.
  • Infringing upon third parties' rights to honor, privacy, or self-image.
  • Posting obscene or violent content, content inciting criminal offenses, or content constituting harassment or threats against any person.
  • Engaging in advertising, spam, unauthorized links, phishing practices, or commercial promotion not consented to by the Company.
  • Infringing third-party intellectual or industrial property rights, including the unauthorized reproduction of copyrighted text, images, or content.
  • Disseminating false or manifestly misleading information presented as facts, likely to cause harm to third parties or public debate.
  • Using automated systems (bots), multiple accounts, or any technique intended to manipulate the rating system or the volume of comments.
  • Posting, in general, any content that is unlawful under applicable Andorran or international regulations.

6. User Responsibility for Published Content

The User is solely and exclusively responsible for the comments, ratings, and any other content they post, as well as for any civil, administrative, or criminal consequences arising therefrom.

As a general rule, the Company acts as a service provider hosting content generated by third parties without systematic prior verification of each comment, without prejudice to the moderation powers described in clause 8.

The User agrees to hold the Company harmless against any claim, penalty, or damage arising from content posted by them that violates the law, this Policy, or third-party rights.

7. License for User-Generated Content

The User retains ownership of intellectual property rights over the comments and ratings they post, to the extent that they are original.

However, by posting a comment or rating, the User grants the Company a non-exclusive, royalty-free, worldwide license for the maximum legally permissible duration to reproduce, publicly communicate, store, moderate, display, archive, and, where applicable, cite such content on the Website and its associated channels (including social networks), for the sole purpose of operating, managing, and promoting the Company's commenting service.

This license does not imply any transfer of ownership or authorization for third parties outside the Company to commercially exploit the User's content without the User's express additional consent.

8. Moderation Powers of the Company

The Company reserves the right, without obligation to exercise it priorly or systematically, to review, edit, hide, flag, or remove any comment or rating that, in its reasonable judgment, breaches this Policy, is unlawful, or could generate liability for the Company.

Exercising these moderation powers does not make the Company an editor of User-generated content, without prejudice to its duty to act diligently upon notifications of unlawful content pursuant to clause 13.

The Company may retain removed content and data associated with its author for the period necessary to comply with requests from competent judicial or administrative authorities.

The Company may cooperate with Andorran judicial, law enforcement, or administrative authorities and provide information required in accordance with the law for the investigation of potential illegal acts committed through comments.

9. Account Suspension and Cancellation

The Company may temporarily suspend or permanently cancel a User's account, with or without prior notice depending on the severity of the circumstances, in cases such as: repeated or serious breach of this Policy; posting manifestly illegal content; identity theft; fraudulent use of the service; or by order of a competent authority.

Account cancellation does not relieve the User of liability arising from previously posted content, which may remain visible to the extent permitted by law.

The User may request the deletion of their account at any time, without prejudice to exercising their data protection rights under the Privacy Policy.

10. Minors

Access to registration and commenting/rating features is restricted to adults of legal age. The Company does not knowingly collect data from minors and, if made aware of a registration made by a minor, will proceed to suspend the account and delete associated data, without prejudice to any applicable legal action.

11. Intellectual Property of the Company

The editorial content of the Website (news, articles, photographs, videos, trademarks, and design) is owned by the Company or third-party licensors and is protected by Andorran and international intellectual and industrial property laws. The license granted by the User in clause 7 does not grant the User any rights over such editorial content, whose unauthorized reproduction, distribution, transformation, or public communication is expressly prohibited.

12. Disclaimer of Warranties and Limitation of Liability

The Company does not guarantee the availability, continuity, or infallibility of the commenting and rating service, nor the truthfulness, accuracy, or legality of content posted by Users.

The Company shall not be liable for any damages that may arise from comments or ratings posted by Users, without prejudice to its duty of diligent removal upon well-founded notifications pursuant to clause 13.

The foregoing applies without prejudice to liabilities that cannot be excluded or waived under Andorran law.

13. Channel for Notifying Unlawful Content

Any User or third party who considers that a comment or rating infringes the law, this Policy, or their rights may notify the Company via the public email addresses provided on the Website, indicating: precise identification of the content (URL, date, and author if available), specific reason for the claim, and contact details of the notifier.

The Company will evaluate the notification with reasonable diligence and, if appropriate, remove or block access to the content, without this implying any admission of liability or prejudging the legality or illegality of the notified content.

14. Amendments to the Policy

The Company may modify this Policy at any time to adapt it to legal, technical, or organizational changes. Modifications will be published on the Website and, when substantial, notified to registered Users prior to taking effect. Continued use of the service after changes are published implies acceptance thereof.

15. Applicable Law and Jurisdiction

This Policy is governed by the laws of the Principality of Andorra. To resolve any dispute arising from its interpretation or fulfillment, the parties submit to the courts and tribunals of Andorra, expressly waiving any other jurisdiction that may correspond to them, without prejudice to any rights that consumer protection regulations may grant to Users who qualify as consumers.
